Note to Lessors: Equipment Hire Terms and Conditions Checklist

Important Disclaimer

Prum Group Pty Ltd is not a party to any hire agreement between you and a Lessee. We only provide our Platform to connect you with Lessees. You are solely responsible for:

  • Creating your own equipment hire terms and conditions and seeking independent legal advice
  • Ensuring your terms comply with all applicable laws
  • Enforcing your terms with Lessees
  • Any disputes or issues arising from your hire agreements

As required by the Prum Marketplace Terms (clause 2.2), you must include all your hire terms and conditions in your Offer Listing. When a Lessee pays the Offer Price, they accept your terms.

Essential Terms Checklist

When creating your equipment hire terms and conditions, you should include things like: 

Basic Details

  • Clear description of the equipment

Fees and Charges

  • Daily or hourly hire rate
  • Late return fees
  • Security deposit amount (if applicable) and when it will be returned
  • Other charges (such as for damage, cleaning or repairs)

Equipment Use and Care

  • Confirmation equipment is safe and properly maintained
  • Requirement to use equipment properly and safely
  • Any instructions for use (or where to find these)
  • Requirement to have necessary skills and experience
  • Responsibility for damage or loss

Return Requirements

  • When and where equipment must be returned
  • Condition equipment must be in (e.g. clean, refuelled)
  • Consequences of late or failed return

Additional clauses

  • Confirmation you own the equipment (Lessee is only hiring)
  • Rights to terminate hire (by you and/or by Lessee)
  • Liability provisions
  • Governing law of contract (e.g. laws of New South Wales)
  • Reference to Australian Consumer Law (if applicable).
